Welcome to CapeTales (the "Service"), operated by Lead-Lag Media ("Company," "we," "us," or "our"). By accessing or using our website at capetales.com (the "Site"), placing an order, uploading content, or otherwise engaging with our Service, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.
You represent and warrant that you are at least eighteen (18) years of age or have obtained the consent of a parent or legal guardian to use the Service.
The person placing an order must be the parent or legal guardian of the child to be depicted in the comic book, or must have obtained explicit written consent from the child's parent or legal guardian prior to placing the order.
CapeTales is a personalized children's comic book creation service. Customers provide photos of their child (and optionally a stuffed animal or toy), along with the child's name, age, a description of what the child is being brave about, their city or neighborhood, and a preferred art style. Using this information, CapeTales creates a unique, 24-page personalized comic book featuring the child as the hero. The physical book is then printed and shipped to the customer.
CapeTales utilizes artificial intelligence ("AI") technologies, including AI image generation, to create the artwork, character designs, story elements, and layouts in each comic book. By using the Service, you acknowledge and understand that the content of your comic book is generated using AI.
All intellectual property rights in and to the comic books produced by CapeTales — including but not limited to the artwork, illustrations, character designs, story text, dialogue, layouts, page compositions, and all other creative content — are and shall remain the exclusive property of Lead-Lag Media. No transfer of ownership or assignment of intellectual property rights occurs through the purchase of a comic book.

Lead-Lag Media retains the right to use any generated comic book content — with personally identifying information removed or altered — for marketing, portfolio, promotional, demonstration, or advertising purposes. Customers may opt out of this use by providing written notice to legal@capetales.com.
The names "CapeTales," the CapeTales logo, "Every Child Is a Hero," and all related marks, logos, and trade dress are trademarks or registered trademarks of Lead-Lag Media.
All prices are listed in United States Dollars (USD). Current pricing: Single Issue: $99.00 per comic book. Hero Pack: $300.00 for five (5) copies of the same comic book. Prices are subject to change at any time without prior notice. The price displayed at the time of order placement is binding for that order.
All payments are processed securely through Stripe, a PCI-DSS compliant third-party payment processor. CapeTales does not directly collect, store, process, or have access to your full credit card number.
Shipping costs are additional and vary by destination. Current flat-rate shipping tiers are: United States — $5.99; Canada — $14.99; International — $24.99. Shipping rates are subject to change at any time without prior notice. All prices are in USD; the buyer is solely responsible for any currency conversion fees charged by their bank or payment provider.
Production typically takes five to ten (5-10) business days from the date of order confirmation. Shipping times vary by location.
If your product arrives with physical damage that occurred during shipping, you may contact legal@capetales.com within seven (7) calendar days of delivery for a replacement of the same book only.
AI-generated content imperfections, style variations, minor text errors, inconsistencies in character appearance, or any other characteristics inherent to AI image generation do NOT qualify for a refund, replacement, credit, or any other remedy.

It is the buyer's responsibility to ensure that the ordered product complies with all laws and regulations in their country of residence.
By uploading photos and providing information, the Customer represents and warrants that they are the parent or legal guardian of any minor depicted, they have the legal right to provide the photos and information, the photos do not infringe on any third party's rights, and all information provided is accurate and truthful.
CapeTales reserves the right to refuse any order at its sole and absolute discretion.
CapeTales reserves the right to refuse orders that request inappropriate, offensive, violent, sexual, discriminatory, or illegal content. Stories will maintain a positive, age-appropriate tone. CapeTales determines content appropriateness at its sole discretion.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
The Customer agrees to indemnify, defend, and hold harmless Lead-Lag Media, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising from the Customer's breach of these Terms, misuse of the Service, unauthorized use of photos, or violation of any third party's rights.
These Terms shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in New York, NY.
For international customers: These Terms are governed by the laws of the State of New York, United States of America, without regard to conflicts of law principles. International buyers agree to submit to the exclusive jurisdiction of the state and federal courts located in New York for any matters not subject to arbitration. Nothing in these Terms limits or waives any mandatory consumer protection rights to which a buyer may be entitled under the laws of their country of residence, to the extent such rights cannot be contractually waived.
Lead-Lag Media reserves the right to modify, update, or revise these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the modified Terms.
Lead-Lag Media may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Sections regarding intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the Customer and Lead-Lag Media regarding the Service.
